Terms of Service & Conditions of Use
Introduction and Legally Binding Agreement
Welcome to ReservationPoints.com ("we," "us," "our," or "the Company"). These Terms of Service and Conditions of Use ("Terms") constitute a legally binding contract between you ("you," "your," or "User") and the Company regarding your access to and use of our website, applications, and digital services (collectively, the "Services").
By accessing, browsing, or using the Services in any manner, you expressly acknowledge that you have read, understood, and unequivocally agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy, which are incorporated herein by reference.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.
Definitions
- "Services" means all digital document preparation, itinerary generation, hotel reservations, and visa application assistance provided by the Company.
- "Digital Assets" means any flight itinerary, dummy ticket, hotel booking, cover letter, or travel plan delivered electronically.
- "Embassy/Consulate" refers to the official diplomatic missions or third-party visa processing agencies (e.g., VFS Global, TLScontact) handling visa applications.
Scope of Services and Limitations
ReservationPoints.com is a specialized document preparation and consulting service. We provide temporary flight itineraries, verifiable accommodation bookings, and custom travel documents intended strictly for visa application and proof of onward travel purposes.
CRITICAL LIMITATION OF SERVICE
The documents we provide are TEMPORARY RESERVATIONS. They are NOT confirmed, fully paid electronic tickets (e-tickets) or hotel stays meant for actual travel. You must not attempt to board a flight or check into a hotel using our temporary documents. You are strictly responsible for purchasing actual finalized travel arrangements once your visa is approved.
Furthermore, we act as an independent service provider and are not affiliated with, endorsed by, or partnered with any government agency, embassy, consulate, or official immigration authority. We do not provide legal advice, nor do we act as immigration attorneys.
User Obligations and Acceptable Use
As a condition of using our Services, you represent, warrant, and covenant that:
- You are at least 18 years of age and possess the legal capacity to enter into binding contracts.
- All information you provide (including names, passport details, and travel dates) is completely accurate, current, and truthful.
- You will not use the Services for any fraudulent, malicious, unlawful, or deceptive purposes.
- You will not attempt to manipulate, forge, alter, or modify the Digital Assets delivered by us to misrepresent facts to an embassy or authority.
- You will not use automated scripts, scrapers, bots, or unauthorized APIs to access or extract data from our website.
Any violation of these obligations constitutes a material breach of these Terms, resulting in immediate termination of your access without refund and potential legal action.
Ordering, Pricing, and Payments
Pricing: All prices are clearly displayed at the point of checkout. We reserve the right to modify our pricing structure at our sole discretion. Any changes will not affect orders that have already been confirmed and paid.
Payment Terms: Full payment is required before the commencement of any service. We process payments through secure, PCI-DSS compliant third-party gateways (e.g., Stripe, PayPal). By providing payment information, you authorize us to charge the applicable fees to your selected payment method.
Taxes: Prices may be exclusive of applicable taxes. You are responsible for any statutory sales tax, VAT, or levies imposed by your local jurisdiction.
Delivery and Processing Times
We offer tiered processing speeds (e.g., Standard, Fast, Super Fast). While we make every commercially reasonable effort to adhere to these timeframes, all stated delivery times are estimates and not absolute guarantees.
Delivery is executed electronically via the email address provided during checkout. The Company holds no liability for delivery delays caused by incorrect customer email addresses, aggressive spam filters, third-party email server downtime, or force majeure events.
No Refund and Cancellation Policy
Due to the immediate, bespoke, and digital nature of the services rendered, ALL SALES ARE STRICTLY FINAL AND NON-REFUNDABLE, except as explicitly mandated by consumer protection laws or outlined in our specialized Refund Policy.
We do not provide refunds for:
- Visa application rejections, denials, or delays by consular authorities.
- Changes in your travel plans, itinerary, or personal circumstances after an order is processed.
- Errors resulting from incorrect or misspelled information submitted by the User.
- Expiration of the temporary reservation's validity period before its use.
Initiating a chargeback or payment dispute for fulfilled services constitutes a breach of contract and fraudulent behavior. Defended chargebacks may incur administrative recovery fees assessing up to £50.00.
Disclaimers: Visa Approval and Travel Validity
The ultimate issuance of a visa, travel permit, or immigration benefit rests entirely within the sovereign discretion of the respective government authorities. The Company guarantees neither the success of your visa application nor the acceptance of our temporary documents by any specific consular officer.
The temporal validity of PNR (Passenger Name Record) codes and hotel confirmation numbers depends on airline and hotel inventory systems beyond our control. Users must plan their embassy appointments to coincide closely with document generation to maximize reservation status stability.
Intellectual Property and Licensing
All content, features, and functionality on the website—including software code, algorithms, UI/UX designs, text, graphics, logos, trademarks, and document templates—are the exclusive property of ReservationPoints.com or its licensors and are protected by international copyright, trademark, trade secret, and intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access the website and utilize the delivered Digital Assets strictly for your personal, non-commercial visa application purposes. You may not reproduce, distribute, reverse-engineer, commercially exploit, or create derivative works from our proprietary materials.
User-Generated Content and Submissions
If you submit feedback, reviews, testimonials, or feature suggestions ("Submissions"), you grant the Company a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, publish, and distribute such Submissions for marketing and operational improvements without compensation or attribution to you.
Third-Party Links and Services
Our website may contain links to third-party websites, advertisers, or services (e.g., travel insurance providers, airlines) that are not owned or controlled by us. We assume no responsibility for the content, privacy policies, or practices of any third-party websites.
You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any such third-party content, goods, or services.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS.
To the maximum extent permitted by applicable law, ReservationPoints.com expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Services will be uninterrupted, secure, error-free, completely shielded from cyber attacks, or that defects will be corrected.
Limitation of Liability
IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF TRAVEL ARRANGEMENTS, MISSED FLIGHTS, DATA LOSS, OR REPUTATIONAL DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless ReservationPoints.com, its parent companies, subsidiaries, affiliates, and their respective officers, directors, and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable legal and attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any copyright or privacy right; or (d) any claim that your use of the documents caused damage to a third party or resulted in legal action by government authorities.
Dispute Resolution and Binding Arbitration
Mandatory Informal Resolution: Before filing any formal legal claim, you agree to attempt to resolve the dispute informally by contacting our legal team at [email protected]. We will attempt to resolve the dispute within thirty (30) days.
Arbitration Agreement: If the dispute cannot be resolved informally, you agree that any and all controversies, disputes, or claims arising out of these Terms or the Services shall be settled strictly by binding arbitration, rather than in court. The arbitration shall be conducted in the United Kingdom, in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitrator's decision shall be final and legally binding.
Class Action Waiver
YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Unless both you and the Company agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Force Majeure
The Company shall under no circumstances be held liable or responsible for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation: internet failures, telecommunications equipment failures, electrical power failures, strikes, labor disputes, riots, civil disturbances, pandemic outbreaks, global travel bans, fires, floods, storms, explosions, acts of God, war, acts of terrorism, or government regulatory actions.
Termination and Suspension
We reserve the unilateral right to immediately terminate, suspend, or restrict your access to the Services, without prior notice or liability, for any reason whatsoever, including but not limited to your breach of these Terms, suspected fraudulent activity, or abusive behavior toward our support staff.
Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law and Jurisdiction
These Terms shall be governed by, construed, and enforced in accordance with the laws of England and Wales, without giving effect to any conflict of law principles. Any legal action or proceeding that is not subject to arbitration shall be brought exclusively in the courts located in London, United Kingdom, and you hereby consent to the personal jurisdiction of such courts.
Consumer Rights and Statutory Guarantees
Nothing in these Terms shall seek to exclude or limit any statutory rights you may have as a consumer under applicable local laws (e.g., the UK Consumer Rights Act 2015 or EU Directives), provided that such rights cannot be legally excluded or limited. In such jurisdictions, our liability shall be limited to the greatest extent legally permitted.
Electronic Communications and Signatures
By using the Services, you consent to receiving electronic communications from us. These communications may include order updates and marketing materials. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
Severability and Waiver
Severability: If any provision of these Terms is held to be unenforceable, invalid, or illegal by a court or arbitrator of competent jurisdiction, such provision will be modified to the extent necessary to render it enforceable while preserving the original intent, and the remaining provisions of these Terms will remain in full force and effect.
Waiver: No waiver of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term. The Company's failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Entire Agreement and Assignment
These Terms, our Privacy Policy, and any specialized service agreements agreed to at checkout constitute the sole and entire agreement between you and ReservationPoints.com regarding the Services, superseding all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer our rights and obligations securely under these Terms without restriction or notification.
Policy Modifications
We reserve the absolute right, at our sole discretion, to modify, amend, or replace these Terms at any time. The most current version will always be posted on this website with the "Last Updated" date revised. Material changes will be communicated via prominent notice on the site or direct email. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
